Welcome to Tycho Data, Inc. ("Tycho Data", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of https://tychodata.com (the "Site") and any related materials or trial software provided by Tycho Data (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, you may not use the Service.
These Terms apply to visitors and users of the Service, including those participating in a free trial.
If you or your organization have executed a separate Master Service Agreement, Order Form, or other written contract with Tycho Data, the terms of that agreement shall govern to the extent of any conflict with these Terms.
You must be at least 18 years old to use the Service.
You agree to provide accurate and complete information when creating an account (if applicable) and to keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Tycho Data may provide access to its software on a free trial basis.
Free trials are for evaluation purposes only.
At the end of a trial, Tycho Data may delete any trial-related data or information.
Trials do not automatically convert into paid subscriptions; continued use requires a separate agreement with Tycho Data.
You retain ownership of all data you use in connection with the Service.
For on-premises trials, Tycho Data may request temporary access to limited data solely for support and evaluation purposes.
Tycho Data does not claim rights to your operational or system data, and any trial data will be deleted after the trial ends.
Both parties agree to protect each other's confidential information and not disclose it except as required by law.
The Service, including the Osprey software, all related technology, and all content provided by Tycho Data are proprietary to Tycho Data, Inc.
Except as expressly permitted in a written agreement with Tycho Data, no rights are granted to copy, modify, distribute, or create derivative works of the Service.
All rights not expressly granted are reserved by Tycho Data.
You agree not to use the Service:
Tycho Data may suspend or terminate your access to the Service at any time for violation of these Terms, misuse, or non-payment (where applicable).
Upon termination, you must cease use of the Service, and any outstanding payment obligations remain due.
Provisions regarding confidentiality, intellectual property, disclaimers, limitations of liability, and governing law shall survive termination.
The Service is provided on an "as is" and "as available" basis.
Tycho Data disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, non-infringement, and fitness for a particular purpose.
To the maximum extent permitted by law:
Tycho Data shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.
Tycho Data's total liability arising out of or related to the Service shall not exceed the amounts paid by you (if any) to Tycho Data for the Service in the twelve (12) months preceding the claim. For free trials, liability shall be limited to zero US dollars ($0).
If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you agree that Tycho Data may use it without restriction or obligation, including for product development and improvement.
The Service may contain links to third-party websites or services. Tycho Data is not responsible for the content, privacy policies, or practices of any third party. Accessing those sites is at your own risk.
These Terms shall be governed by and construed under the laws of the State of Texas, United States, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the state and federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
